Patients Challenge Clarian's Charging Of Uninsured
Suit Seeks Class Action Status

INDIANAPOLIS -- Two uninsured patients have filed a lawsuit against Clarian Health, claiming they were overcharged because they had no health insurance.The suit alleges that Clarian billed the patients at chargemaster rates, which are significantly higher than rates negotiated by insurers or Medicare, 6News' Renee Jameson reported."We contacted the insurance and asked them, 'If you were to cover it, how much would you have covered?' And they said half … It was $15,000, and they said $7,000, and that just doesn't seem right," said plaintiff Abby Allen.
She and another uninsured patient want a Marion County judge to declare those rates unreasonable and unenforceable."She's not asking for additional moneys, and she's not asking for free services," said attorney Jerry Garau. "She understands she needs to pay for the services she received. All she's asking for is a fair shake."Allen, who plans on going to school to become a nurse, said she is willing to pay the bill, but thinks it shouldn't be more than insured patients are asked to pay."I do believe you should be responsible for paying it but at a reasonable price," she said.The suit also seeks class action status, in an effort to represent all of Clarian's uninsured patients.Clarian issued a statement in reference to the suit on Friday afternoon."Clarian officials are currently reviewing the complaint and will investigate the allegations made by the plaintiffs. Clarian plans to issue a timely response to this new suit, in accordance with Indiana trial rules, and to defend this action," the statement read.
