Gag Order Violation Still Under Investigation

Russell Yates spent Christmas morning at the Harris County Jail visiting his wife, Andrea, who's accused of drowning their five children.

In an exclusive report, Russell Yates told KPRC-TV that he had a nice visit with his wife, alone.

"Andrea and I just reminisced something about the children when we visited," Russell Yates said. "Yes, had a good visit."

When asked what Christmas was like this year, Russell Yates said that he didn't want to answer that question.

Andrea Pia Yates, 37, was arrested June 20 after police said she called them to the family's southeast Houston home and admitted drowning her children in a bathtub. She has since been charged with capital murder in the deaths of three of the five children.

Six days after the killings, State District Judge Belinda Hill imposed the gag order on June 26.

Gag Order Investigation

Meantime, Russell Yates could still be in hot water for possibly violating his gag order after speaking to the media.

During an interview with "60 Minutes" on Dec. 9, an emotional Russell Yates said that he loved his wife and that he doesn't blame her for the children's deaths.

He also showed home videos of his children and Andrea Yates during the program.

Harris County District Attorney Chuck Rosenthal also spoke out during the news program and discussed why he thought seeking the death penalty was appropriate for Andrea Yates.

Judge Hill has appointed a special prosecutor to look into whether Russell Yates or Rosenthal violated the gag order. Both men face a $500 fine or six months in jail if they are found in contempt of the court's order.

Andrea Yates has pleaded innocent by reason of insanity. If convicted, she faces the death penalty. Jury selection in her case is scheduled to begin on Jan. 7.
