Man Wants Sexual Battery Charge Wiped From Record

Parole Board To Hear Pardon Request Tuesday

POSTED: 7:52 pm EDT April 2, 2007

A man convicted of sexual battery and impersonating a police officer will ask the Indiana Parole Board to clear his criminal record during a hearing Tuesday, 6News' Jack Rinehart reported.

Michael Sherfick, who pleaded guilty in 1994 to Class D felony sexual battery in a case involving an Indianapolis woman, already has successfully petitioned a court to reduce the felony to a misdemeanor and get his name removed from the state's sex offender registry.

Sherfick also has been convicted of impersonating a police officer and being a habitual traffic offender.

Sherfick has held public safety jobs, but controversy over his convictions led to his firing from his job as assistant town marshal in Brooklyn years ago.

Also, he was a special deputy with the Boone County Sheriff's Department, but his credentials there were revoked in 2005 after Indianapolis police said he tried to use them to get himself out of a traffic citation.

Marion County's prosecutor learned of the case and told Boone County's sheriff that Sherfick should not be a special deputy because of his sexual battery and police impersonation convictions. A day after the inter-county communication, the sheriff said he revoked the credentials.

Sherfick received a suspended three-year prison sentence in the sexual battery case. The victim in the case told 6News on Monday that s she was against Sherfick's request to clear his record, calling him a predator who always has been able to slide out of trouble.

When Sherfick was sentenced for the sexual battery charge in 1994, the victim wrote to the court that the assault made her flee Indiana and that she could never forget what happened to her.
