Indiana Murder, Rape Charges Await Ariz. Inmate
Woman Says Trial Can't Come Soon Enough

KOKOMO, Ind. -- A man who is currently incarcerated in Arizona will be sent to Indiana to face murder, rape, kidnapping and burglary charges stemming from a case more than four years old.Investigators said Jerry Brackett, 48, killed Joseph Elvin Pate, 70, and kidnapped Pate's wife, Mary Pate, 57, in January 2003.Police identified Brackett as a suspect in the case shortly after Joseph Pate's death. Police found Brackett and Mary Pate in Arizona later that month.
Brackett exchanged gunfire with officers in Arizona and was convicted on numerous crimes relating to that confrontation. He was sentenced to about 35 years in prison on those Arizona charges.Last week, however, a Howard County, Ind., court issued a warrant charging Bracket with murder, two counts of rape, kidnapping and burglary. Kokomo officials said arrangements are being made with Arizona officials to bring Brackett to Indiana to be tried on those charges.Joseph Pate's widow, now named Mary Turnpaugh, told 6News' Jennifer Carmack that the Indiana trial cannot come soon enough."I want him to pay the price. I want him to know he cannot get by with this," Turnpaugh said Tuesday.
