Mistakenly Released Man Apprehended

INDIANAPOLIS -- A man who was mistakenly released from jail was apprehended Friday night, police said.Tony Mays, 30, was allowed to leave the Marion County Jail this week even though he still had eight years left to serve on a drug conviction.Police said Mays was found in the 3700 block of Whenner Drive, just off 38th Street, at about 9:15 p.m.
Mays had been transferred from a state prison to the Marion County Jail so he could appear in court on a misdemeanor drug charge -- which at most could have brought a one-year jail sentence.A judge sentenced Mays to jail time already served for the misdemeanor. Mays should have then returned to prison to continue serving time for his other conviction, but jailers released him.Julio Fernandez, a spokesman for the Marion County Jail, said the jail had no record indicating Mays was supposed to return to prison.
