Plea Agreement Would Negate Murder, Kidnapping, Rape Charges

KOKOMO, Ind. -- A man accused of killing a Kokomo man and then kidnapping and raping his wife may take a plea deal that would mean he wouldn't serve time in Indiana.Jerry Brackett is currently serving a 36-year sentence in Arizona after a 2003 shootout with police.Brackett fled there after he killed Elvin Turnpaugh and kidnapped and raped his wife, Mary Turnpaugh, Kokomo police said.
Under the plea agreement, Brackett would plead guilty to voluntary manslaughter and burglary in exchange for a 40-year sentence. That time would be served concurrently with his sentence in Arizona.Mary Turnpaugh told 6News' Jennifer Carmack she is angry that Brackett could even get such a deal."He's getting away with murder, rape, kidnapping and burglary," Turnpaugh said. "To me, that says go out here do what you want and we'll plea with you and you don't have to do no time for it."Kokomo Police Lt. Donald Whitehead said he understands Turnpaugh's frustration, but said that even if Brackett takes the deal, he will be 81 years old when he's released."The last thing I would ever want to see is Jerry Brackett back on the street," Whitehead said. "If that were any possibility, I would be concerned about this."Brackett will be transported back to Arizona following his plea hearing in Howard County.6News made several attempts to speak with the Howard County Prosecutor's Office, but the calls were not returned.
