Brian Reese Requests Transfer From Marion County Jail

A man being held on charges of attempted murder in the shooting of Indianapolis police Officer Jason Fishburn last year claims he's being mistreated at the Marion County Jail.

An attorney for Brian Reese, 37, filed a motion asking that his client be moved out of the jail because he is in danger of serious injury or death, 6News' Derrik Thomas reported.

Reese said that corrections officers deliberately over tighten his belly chains, anklets and handcuffs to cause him pain, and that he's being denied certain privileges after being placed in isolation.

"He is a human being and I expect that he be treated as such. If they want to isolate him, that's OK, but give him a TV, a newspaper, give him the ability to have exercise and recreation," said Reese's attorney, David Shircliff.

The sheriff's department denied any mistreatment while Reese awaits trial.

"He's whining about a lack of privileges, he's complaining that he can't watch TV or get regular newspaper delivery. With all due respect, when you are alleged to have committed crimes like this and when you've said you are in imminent risk of injury, and you are in isolation, those things are going to happen," said Tom Wheeler, the department's attorney.

The department said it would be too costly to transfer Reese, which would involve paying $65 a day to the state, plus transportation to and from a state facility.

Reese is also charged with three counts of murder in an unrelated case.

Fishburn was attempting to arrest Reese on robbery charges when Reese shot him in the head, police said.

Fishburn survived the shooting, but is still undergoing rehabilitation for the injuries he suffered.

A hearing on Reese's transfer request is set for June 26.
