Family Prepared To Relive Tragedy At Reese Trial
Week-Long Trial Begins Monday In Officer Fishburn Shooting

INDIANAPOLIS -- The family of Indianapolis police Officer Jason Fishburn is preparing itself to relive a painful ordeal as the trial of Brian Reese, the man charged with shooting Fishburn, begins this week in Porter County.Jury selection is set to get under way Monday morning. Prosecutors said Reese, 37, shot Fishburn last year as the officer tried to arrest him as part of a murder investigation.Previous Slideshow: IMPD Officer ShotPolice said they found a .38-caliber handgun near Reese, who was apprehended after other officers shot him in the shoulder.The trial was moved from Indianapolis to northwest Indiana earlier this year because of pre-trial publicity."I think there will be tender moments, some shedding of tears," said Sgt. Dennis Fishburn, Jason's father. "At the same time, each time we shed a tear, I think it's going to build some character. It's going to help heal us."The Fishburns will be in Valparaiso for the trial by Monday afternoon. Jason is expected to be the state's first witness, but family members don't think he'll take the stand until Tuesday morning.When asked Sunday what he planned to say on the stand, Jason Fishburn said, 'I don't remember anything."Fishburn, who was shot in the head and chest on July 10, 2008, said he recalls nothing about the circumstances of the shooting.His mother, Mary Fishburn, said she thinks Jason's testimony could be the most powerful for jurors to hear."I think when they look at the extent of his injuries and know ... he was shot in the head and lost 10 percent of his brain … there's a reason he doesn't remember everything," she said. "Justice will prevail."The family expects an emotional rollercoaster as they relive tragic events in the courtroom this week.Fishburn's wife, Tonya, is also expected to take the stand."The prosecutor and courts are doing the right thing by moving it out of venue," she said. "It's important Reese gets a fair trial, and we only have to do this trial one time."Fishburn's brother, Kyle Fishburn -- an officer in Columbus, Ohio -- said he will attend the trial to provide moral, emotional and spiritual support for his brother.Jason Fishburn's recover has been slow and arduous, but ultimately rewarding. Eighteen days after the shooting, he was sent to a rehabilitation center. Fishburn was sent home on Sept. 11, 2008 and went back to light-duty work with the police department on May 18, 2009."I'm just glad I am still alive, and every single day, I thank God," Jason Fishburn said.
