Opening statements will begin Tuesday morning in the trial of Brian Reese, 37, in the 2008 shooting of Indianapolis police Officer Jason Fishburn.

Reese's trial was moved to Porter County earlier this year so a jury might be found that had not already heard about the case.

About 120 jurors were summoned to the courthouse in Valparaiso, 6News' Derrik Thomas reported, and seven men and five women were chosen.

Marion County Prosecutor Carl Brizzi said "a couple" of potential jurors said they had read about the shooting online and were dismissed.

Reese was charged with attempted murder, resisting law enforcement and carrying a handgun without a license.

On July 10, 2008, Fishburn and other officers were chasing Reese on foot in the 800 block of Euclid Avenue.

When other officers heard shots fired, they turned their weapons on Reese, striking him in the shoulder.

Prosecutors said officers found a handgun on the ground close to Reese and then found Fishburn suffering from gunshot wounds to the head and chest.

"It's not a crime unless the jury says it's a crime. The jury is vitally important for this case," Brizzi said. "It's a little unfamiliar territory for both the state and the defense. Today, we hope to pick a jury that is fair to both the defendant and the state of Indiana."

Defense attorney David Shircliff declined to comment extensively, but said that his client did not intend to kill Fishburn.

The trial is expected to last about a week, and Fishburn is expected to be the prosecution's first witness.

6News' Derrik Thomas is in Porter County and will provide coverage of the trial this week on 6News and TheIndyChannel.com.
