Demoted Officers Call On Mayor To Review Case
Assistant Chief Phoned Ciesielski, Called Away To Meeting

INDIANAPOLIS -- Two Indianapolis police officers demoted in the wake of the botched case of Officer David Bisard's crash are calling on the mayor to review exactly why they were reassigned.Assistant Chief Darryl Pierce and Cmdr. John Conley were removed from their positions and demoted to lieutenant following the investigation into the Aug. 6 fatal crash that left a motorcyclist dead.

"They're not challenging the chief's discretion. They are, however, challenging the way this was done, particularly characterizations of them not doing their job properly," attorney Robert Turner told 6News' Joanna Massee.Pierce, Conley and then-Deputy Chief of Operations Ron Hicks -- who was also demoted, but is not represented by Turner -- all responded to the crash.Pierce's phone records show eight phone calls between Pierce and Police Chief Paul Ciesielski during a 71-minute period after the crash."Chief Pierce immediately contacted Chief Ciesielski and told him that, based upon the evidence, the crime scene and so on, it did not look good," Turner said.Turner also provided an e-mail sent from Ciesielski the same day of the crash referring to a meeting for all command staff, which Turner said was about the image of Indianapolis Public Safety Director Frank Straub's relationship with the Police Department."They discussed a public relations concern regarding the public safety director and were asked to make comments in support of the public safety director," Turner said.Pierce and Hicks left the scene to attend the 1 p.m. meeting, Turner said, while Conley stayed there.Turner said Conley did not stop officers from taking Bisard to an occupational health clinic instead of a hospital for his blood draw, which now cannot be used to prosecute Bisard on alcohol-related charges.Turner said officers were trying to prevent Bisard from being treated in an area where he may run into victims' family members.Conley was replaced on Monday by Captain Ted Fries, who was sworn in as the new major of Homeland Security. Fries was previous the day shift field captain for the Southwest District.Lt. George Crooks, the leader of the Fatal Alcohol Crash Team and the first to be demoted after Bisard's crash, has been asked to be reinstated.Crooks' attorney argued that his client is not at fault because the crash team was not told to respond to the crash, per standard procedure in a crash in which alcohol was involved.
