Another Motorcyclist Hit By Bisard To Sue

Lawmakers Call For Review Of Investigation

The family of one of the motorcyclists struck by Officer David Bisard plans to sue the city, while some lawmakers are calling for a review of the investigation into the fatal crash.

Bisard, a nine-year veteran, was on duty when he struck a group of motorcyclists stopped at a red light Aug. 6, killing Eric Wells, 30, and injuring Kurt Weekly, 44, and Mary Mills, 47.

On Tuesday, an attorney representing Weekly filed a tort claim notice seeking damages in excess of $700,000, 6News' Joanna Massee reported.

"Kurt Weekly sustained personal injuries; incurred medical expenses, lost wages, endured pain, suffering and metal anguish; and will continue to suffer such damages in the future," the notice reads. "It is unlikely he will be able to return to his prior employment as an accountant with the Department of Defense."

Attorney Bruce Kehoe told Massee that Weekly has been in a comatose state. He said he has been opening his eyes, but is unable to respond to commands.

Weekly was expected to be transferred from Methodist Hospital to Saint Vincent Seaton Specialty Hospital Tuesday evening.

Mills' family has also filed a tort claim with the city.

City-County Council Review

Also Tuesday, Democratic City-County Council members Brian Mahern and Joanne Sanders called for a bipartisan council investigation of public safety and police leadership's response to Bisard's crash.

"We believe the public does not have all the facts it should about how the city's leadership reacted to this tragedy since it occurred," Mahern said.

Sanders noted that the City-County Council does have subpoena power to request both documentation and individuals.

"What this committee would do is try to understand what happened that day and in the immediate weeks following, and whether or not that response was appropriate, but more importantly, exactly what that response was," she said.

The Council would have to pass a resolution to form the investigative committee.

Alcohol-related charges against Bisard were dropped after a judge ruled that proper procedures weren't followed in the investigation. He is charged with reckless homicide and criminal recklessness.

Bisard is suspended pending termination from the department.
