Suspect In Killings Of 7 Withdraws Speedy-Trial Request

One of two men charged with murder in last week's fatal shootings of seven people withdrew his request for a speedy trial Thursday.

Desmond Turner, 28, had invoked his constitutional right for an expedited process during a hearing on Wednesday. The move would have required that his trial start within 70 calendar days, so a trial date of July 17 was set.

After Turner consulted with defense attorney Brent Westerfield, Turner withdrew the request Thursday, 6News' Derrik Thomas reported.

Marion County Prosecutor Carl Brizzi is seeking the death penalty against Turner, and defense lawyers typically need months to prepare for death-penalty cases.

A new trial date has not been set.

Turner and James Stewart, 30, face murder and other charges in the June 1 killings of three boys and four adults in a house at 560 N. Hamilton Ave.

Police said they believe the killings happened as Turner and Stewart robbed the home, allegedly acting on a false rumor that they would find large amounts of cash and cocaine there.

Brizzi said Tuesday that as of right now, he would not seek the death penalty for Stewart, but that he could decide to do so in the future.

The seven who were killed were: Alberto Covarrubias, 56; Emma Valdez, 46; her sons David Covarrubias, 8, Alberto Covarrubias, 11, and Magno Albarran, 29; her daughter, Flora Albarran, 21; and Flora Albarran's son, Luis Albarran, 5.

The funeral for the elder Covarrubias, who was the father of David and the younger Alberto, was held Tuesday. A funeral for the rest was held Wednesday.
