Hoosiers who took sleep medicine could get money

If you used a certain sleep medication, you could be entitled to money thanks to a multi-state settlement.

Drug company Cephalon intentionally misled the United States Patent and Trademark Office for the purpose of preventing competition, according to the Indiana Attorney General’s office.

Hoosiers who purchased either brand-name Provigil or generic modafinal from June 24, 2006 to March 31, 2012 are eligible to be a part of a $35 million settlement.

The drugs treat adults with excessive sleepiness associated with narcolepsy, obstructive sleep apnea and shift work disorder.

The deadline to file a claim is April 13.

The Indiana Attorney General reached the settlement in August 2016, along with 48 other states, with Cephalon and its affiliated companies-  Teva Pharmaceutical Industries, Teva Pharmaceuticals USA and Barr Laboratories.

The company resolved allegations that it engaged in unlawful anti-competitive conduct called “pay-for-delay.”

“Pay for delay” involves paying a would-be generic drug competitor to delay its entry into the market, and thus keep prices at artificially high levels.
