FRANKLIN, Ind. -- A Franklin City Council member and deputy prosecutor was arrested over the weekend on suspicion of driving under the influence.

Andrew Eggers, 32, was pulled over around 2 a.m. Sunday near the intersection of Jefferson Street and U.S. 31.

According to the police report, an officer with the Franklin Police Department pulled Eggers over after he failed to signal for a turn.

When the officer approached Eggers' truck, he recognized him as a city council member and reportedly smelled alcohol.

The officer subsequently performed a field sobriety test on Eggers, which he reportedly failed.

Eggers declined to take a portable breathalyzer test, according to the report. He was then taken into custody, whereupon officers received a search warrant to perform a blood draw on him.

Eggers was then arrest on a preliminary charge of driving under the influence. While at the Johnson County Jail, he reportedly agreed to take a portable breathalyzer test and registered a BAC of .104 percent.
