The custody battle for an overweight dog between an animal rescue group and a woman who took him into foster care was won by the portly pooch's foster mom.

Five-year-old Obie topped the scales at nearly 80 pounds, prompting his foster mom to begin a weight-loss campaign.

But an animal rescue group had been fighting for custody on grounds that Obie was being exploited because of his weight.

The rescue group argued that Obie's foster mom was using him for publicity, but she said she's been trying to help the Dachshund slim down.

A judge ruled that the rescue group could not take Obie from his foster mom.
