Judge Will Hear Charlie White's Argument For Dismissal

A Hamilton County judge will allow embattled Indiana Secretary of State Charlie White to argue for a dismissal of the seven felony charges pending against him.

Hamilton Superior Court Judge Steve Nation granted the Dec. 9 hearing Wednesday, a week after White and his attorney, Marion County Prosecutor Carl Brizzi, argued that the motion addresses important legal issues that should be considered.

However, Nation denied requests by White to delay his trial and to remove the special prosecutor appointed to the case.

White is accused of voter fraud and theft. The Republican is accused of voting last year from an address where he didn't live and continuing to take his Fishers town councilman's salary after moving from his district.

His trial is set for Jan. 30. A conviction on any count would force him to give up his office.
