INDIANAPOLIS -
The Indiana Court of Appeals has refused to block the criminal trial of the former chairman of the Indiana Utility Regulatory Commission during the investigation into alleged unethical practices.
David Lott Hardy faces criminal misconduct charges surrounding his handling of the Duke Energy Edwardsport Power Plant case.
Prosecutors said Hardy knowingly allowed a utility regulatory commission attorney to work on the Duke Power Plant case, even though the attorney was also negotiating a job with the utility, and that he had secret communications with the utility about the cost overruns at the plant.
Hardy's attorneys had asked the state to delay the trial as he undergoes treatment for a life-threatening bone marrow disease.
Gov. Mitch Daniels fired Hardy from his position amid the scandal.
