Muncie couple accused of giving 10-month-old marijuana to treat broken leg pain

DELAWARE COUNTY, Ind. -- A Muncie mother and her boyfriend are accused of giving a 10-month-old marijuana to treat her pain from what turned out to be a broken leg. 

The investigation began back on June 18 when, according to court documents, officers were called to IU BMH for an infant with a broken leg. The child's mother, Tessa Murray, 23, initially told officers that the child fell off of the couch while attempting to lower herself down. 

After the child was transported to Riley Hospital for Children for further treatment, Murray changed her story to say that a 9-year-old pulled the infant's leg as she was falling off of a bed. 

After being confronted by investigators about the conflicting stories, police found numerous text messages between Murray and her boyfriend, Nerrell McCoy, discussing the child's injury over previous few days

Documents show that McCoy messaged Murray saying: "She prolly need some weed and she will be good for now." He then messaged her again saying that the child wasn't crying when he touched her leg and he put it "in a book splint last night to keep it straight."

Other messages between the two discuss the extent of the child's injury and the fact that they should have taken her to the hospital sooner. 

The infant was tested for Marijuana based on the text messages and was found to have "excess of what could be attributed to second-hand smoke" in her system. 

Neither McCoy or Murray could provide police with the details of how the child was injured if she hadn't fallen off of the couch. 

Both were arrested Monday and are charged with two counts of neglect of a dependent. McCoy is also charged with two counts of possession of marijuana.
