INDIANAPOLIS -- Jared Fogle stepped up his fight against one of his victims Monday with a new filing in federal court.

Attorneys for the former Subway pitchman say that Fogle doesn't believe he should be held responsible for the victimization of a girl known as 'Jane Doe.'

She is the first one of Fogle's victims to sue him in federal court.

In this most recent court filing, Fogle blames Jane Doe's issues in whole or in part on her mother and/or her father.

The documents say that "personal injuries, mental anguish, emotional distress and damages" occurred before Jane Doe learned in 2015 of any of the allegations against Fogle.

Fogle's attorneys ask that the judge rule in his favor and grant Jane Doe nothing in her complaint for damages.

Fogle is currently serving more than 15 years behind bars at Colorado's Englewood Prison.

An appeal by Fogle to lower his prison sentencewas denied in June by the 7th Circuit Court of Appeals in Chicago.

Fogle could still appeal the ruling to the U.S. Supreme Court.
