Father faces charges after child accidentally shoots mom, sister on Indy's north side

INDIANAPOLIS – A man was charged with neglect of a dependent and criminal recklessness after his 4-year-old daughter, and her mother were accidentally shot on Indianapolis' north side.

Marion County Prosecutor Terry Curry said Kyle Spivey left a loaded firearm in an area that children had access to, which resulted in the shooting at 1606 E. 44th Street on Nov. 13.

The probable cause affidavit stated Spivey and his girlfriend were in their bedroom with their two children, ages 2 and 4, when the 2-year-old got the father's loaded handgun from a dresser and fired the weapon.

The bullet hit the 4-year-old in the face and the mother in the back of the head, according to court documents. The 4-year-old sustained extensive injuries to her face and the mother suffered an injury to her brain, including loss of vision in one eye.

The court document said when the officers arrived on the scene, Spivey said, "not that big of a deal; they will be fine."

He also told police, "my daughter knows how to get it (the gun) out but my son doesn't" officers noted.

Detectives also discovered a photo allegedly posted to social media about one week before the shooting. The photo showed Spivey and his two children holding a weapon.

During the time of the incident, there were two adults and six children in the home, police said.
