INDIANAPOLIS – The man who was nearlycrushed by brick sign while sitting in his vehicle at a Chipotle this past April has filed a lawsuit against the restaurant.

Mike Ford of Indianapolis wants the company to pay for his damages.

The lawsuit also includes the commercial real estate firm and a limited liability company.

Strong winds caused the sign to fall onto Ford’s Honda Accord as he was stepping out of the vehicle to head into the lot’s Sprint store.

A Sprint store employee said the man came into the store bleeding while his co-workers called for help.

"We heard this large crashing sound, I turn around and saw the sign on the car and then a guy just emerged from the car he kind of stumbled around a little bit," Caleb Vilhauer said.

"It is hard to believe. I think it was a miracle that he was able to get out when he did cause if he, another split second probably he would be dead."

Chipotle released a statement on the lawsuit:

“While we regret that this incident occurred and caused any property damage or injury, the lawsuit involves a sign for several tenants in this center and our investigation into the matter continues.”

As a result of the incident, Ford’s car was totaled and he sustained a concussion among other cuts and scratches, according to the lawsuit filed Sept. 28. You can read the full document here at the bottom of this story.

At the time, Ford thought something had fallen out of the sky on his car. He said he took a "good blow to the head."

"I don't know if I have a guardian angel or what," he said. "Something helped me."
