Couple found guilty in death of 1-year-old Elijah Polk

INDIANAPOLIS – An Indianapolis woman and her boyfriend were found guilty Wednesday evening in the death of her 1-year-old son.

Diamond Miller and Frank Larkins were arrested in Nov. 2014 after Miller's 1-year-old son, Elijah Polk, died.

Investigators say the toddler died due to complications from injuries to his abdomen.

Larkins was responsible for the care of Polk and his siblings the evening the child was reportedly injured. Prosecutors said neither Larkins nor Miller sought medical care for Polk for more than 24 hours.

Larkins was found guilty Wednesday evening of aggravated battery, battery resulting in death to a person less than 14 years of age and two counts of neglect of a dependent resulting in death. Miller was found guilty of one count of neglect of a dependent resulting in death.

The couple will be sentenced September 23 in Criminal Court 6.
