Police: Man had run out of gas

INDIANAPOLIS - A Marion County sheriff's deputy hit and killed a man on Indianapolis' near-north side Sunday night, the second time he's hit a pedestrian in less than a year, police said.

The crash happened just after 8 p.m. on the onramp to southbound Interstate 65 from 29th Street near Dr. Martin Luther King Jr. Boulevard.

Deputy Erich Gephart, 41, was driving a department transport van with a prisoner inside when he struck Adam McCarty, 31, of Jamestown, who was on the side of the ramp trying to refuel his pickup truck, which had run out of gas, police said.

"McCarty was in the roadway wearing dark clothing holding a gasoline container, and apparently attempting to add fuel to the truck," the sheriff's department said in a news release. "The lights and emergency flashers of the stalled truck were not on, nor were there flares, reflective triangles or other safety devices employed to warn other motorists."

McCarty was pronounced dead at the scene. Police said his driver's license had been suspended for life in 2011.

Gephart and the prisoner he was transporting were not injured.

The sheriff's department said a blood test showed Gephart was not intoxicated at the time of the crash.

Gephart, who has been an employee of the sheriff's department for six years, was placed on administrative leave pending an investigation.

In November 2011, Gephart hit a pedestrian with his transport van in the 900 block of Fox Hill Drive on the city's north side.

Police said it was dark and the man was walking on the roadway with a 10-year-old relative. He later recovered and Gephart was cleared of any wrongdoing in a police investigation.

"I don't know if it's bad luck. Our hearts go out to everyone involved here, and really, frankly, we're hopeful that IMPD will find facts are are more clear," said Capt. Mike Hubbs with the Marion County Sheriff's Department Investigations Division.
