INDIANAPOLIS - No criminal charges will be filed after a female inmate was reportedly sexually assaulted in the Marion County Jail in July.
Indiana State Police investigated the report that the woman was raped when she was mistakenly placed in the same cell as a male inmate at the jail.
After receiving and reviewing the ISP report, the Marion County Prosecutor's Office decided not to file criminal charges, the office confirmed Wednesday.
Marion County Sheriff John Layton asked ISP to investigate "in order to ensure that an outside agency provides an independent review," he said.
Layton said internal affairs investigators would also evaluate the incident.
"There can be no excuse for this incident," Layton said in July. "I shall take corrective action."
