INDIANAPOLIS -- There will be no criminal charges filed in connection with the school bus accident at Amy Beverland Elementary last month that killed Principal Susan Jordan and injured two students.
Marion County Prosecutor Terry Curry says the decision was based upon a review of all of the evidence, including the fact that no alcohol or controlled substances were found in the driver's blood.
In addition, Indiana law says in the absence of impairment, negligence itself is not a crime.

Curry says the driver disengaged the parking brake prior to the accident and moved the shifter into Forward position. She wasn't able to move the bus because another one was parked beside it.
According to the prosecutor's office, it appears the driver tried to get Principal Jordan's attention and stood up without moving the shifter into neutral or re-engaging the parking brake. The bus moved forward and the driver wasn't able to stop it before the accident.
An inspection of the bus didn't uncover any mechanical problems.
RTV6 is not identifying the driver of the bus since she will not face criminal charges.
