Home intruder shot, killed on Indy's east side

INDIANAPOLIS -- A man who broke into a home on Indianapolis' east side was shot and killed Tuesday morning, police said.

He's been identified as 53-year-old James Neal.

The shooting happened around 5:45 a.m. at a house on the 700 block of South Bosart Avenue.

Police say a family of three, including an 11-year-old girl, was asleep when they heard sounds inside their home.

The husband and wife said they found James Neal standing naked in their kitchen.

They told police they were concerned for their safety and the safety of their daughter.

Detectives say the husband got a shotgun, and he and Neal struggled over the weapon.

The wife got a second weapon from another room.

During the struggle, police say both shot their weapons fatally wounding Neal.

He was pronounced dead at the scene.

The couple and their daughter were not hurt.

The husband and wife cooperated fully with homicide detectives and were released after questioning.

The Marion County Prosecutor's Office says no charges will be filed against the couple.
