JOHNSON COUNTY, Ind. - An Indianapolis man was accused of driving under the influence of alcohol while his daughter was in his vehicle, Johnson County authorities said.
The incident was reported Sunday afternoon near Olive Branch Road and State Road 37 when a Johnson County Sheriff's Deputy saw a silver Jeep swerving in and out of the road. The officer stopped the driver, identified as James Ryan McHale, and noticed a 5-year-old girl sitting in the back of the Jeep.
McHale told the officer he and his daughter had been at a football game and that he had been drinking.
The officer said McHale appeared to be intoxicated and asked him to perform several field sobriety tests. McHale was eventually given a Breathalyzer test. His blood alcohol content was .16 percent, twice the legal limit of .08 percent, police said.
McHale was taken into custody at the Johnson County Jail on charges of DUI and neglect of a dependent.
His daughter was taken into custody by her mother, police said.
