Woman who fatally struck roadside construction worker gets 12-year sentence

INDIANAPOLIS - A motorist who struck and killed a construction worker, who was on the job along 10th Street, was sentenced to prison Wednesday afternoon. 

Lindsey Gipson, 25, was under the influence of morphine when she plowed into the victim.

Gipson pleaded guilty to driving under the influence of drugs, causing the death of Bradley Arthur in May 2012. 

Gipson received a 12-year sentence -- 10 years executed, 2 years suspended. Six of the 10 years will be spent in prison, and the other four years will be served on work release. 

Arthur's wife of 35 years said she thinks the sentence could be harsher.

"I don't think she got long enough, but I also know she needs help and I want to get her help," Mary Arthur said.

Gipson needs help, because she admitted being a drug addict, and she was on probation for a separate drug offense when she struck and killed Bradley Arthur. 

"They don't care, they are just in a hurry. They want to get where they want to go," said Joanna Miller, the victim's daughter, discussing motorists who hit roadside workers. "They don't take into account somebody is there doing their job. They might hit them and take their life. It doesn't matter to them."

In 2011, lawmakers passed legislation to better protect construction workers along the road. That law was not used in this case, because the existing law was better.

Deputy Prosecutor Tom Hirschauer said Marion County Prosecutor Terry Curry and the Indiana Prosecuting Attorneys Council are working on revising that construction worker law. Hirschauer said he thinks revisions are necessary.

"As we are contemplating statutory re-writes, I believe the ability to do a simple enhancement to a higher grade felony if a construction worker is injured while in the line of his employment would protect construction workers in a positive manner," he said.
