Man To Plead Guilty To Neglect In Boy's Shooting Death

The boyfriend of the mother of a 6-year-old boy who was fatally shot by his 11-year-old brother is expected to plead guilty to neglect.Matthew Boulden was charged last June with three counts of neglect after the then-11-year-old shot and killed his brother, Andrew Frye, in their home near Martinsville, the Reporter-Times reported.The boy was later acquitted of murder but convicted of a less juvenile charge of reckless homicide.The boys' mother, Amanda Vandagrifft, 28, was charged with neglect of a dependent, causing death and three additional counts of neglect of a dependent.Police said the couple left the gun where the children had access to it and that they should have known better than to leave the older boy home alone with other children after several violent outbursts.Boulden's plea agreement calls for him to plead guilty to felony neglect. He would serve no more than 180 days in jail and could ask the court to reduce his conviction to a misdemeanor if he completes his probation.

Vandagrifft has also been offered a plea agreement. If she pleads guilty, the jail sentences would be staggered so that one parent would be home with the three remaining children.
