INDIANAPOLIS - A Marion County Sheriff's Office reserve deputy resigned after he was caught on camera using a stun gun on a race fan during the Indianapolis 500 weekend.
Paul McGann was hired in June 2013 and was placed on administrative leave on July 2 after the May 24 incident in the Coke Lot. He officially resigned Aug. 22.
The video shows McGann alone and surrounded by a large crowd of race fans that start to throw objects at him. McGann chased a suspect that he believed struck him with a water bottle and that is when 19-year-old Zachary Pollack intervened in the arrest and McGann used the stun gun.
Pollack was arrested on charges of battery, resisting law enforcement and possession of alcohol by a minor. Three weeks later, the charges were dropped and McGann was later placed on administrative leave.
McGann's attorney issued a statement to the Call 6 Investigators:
"We are confident that Mr. McGann was fully justified and well within the proper exercise of his police powers when he used minimal force to subdue Zachary Pollack who was attempting to interfere with McGann's arrest of another subject."
No charges were filed in the case, but the prosecutor’s office was investigating.
