Docs detail courtroom scuffle between mother and woman convicted of killing her kids at bus stop

FULTON COUNTY — The mother of three children killed at a bus stop accident in 2018 is facing a misdemeanor battery charge for attacking the woman responsible, but no formal charges have been filed at this time.

According to a probable cause document that was filed in Fulton County Superior Court, Brittany Ingle is facing a charge of misdemeanor battery for the attack.

Fulton County Prosecutor Michael Marrs said his office has reviewed the case and has requested a special prosecutor because of how closely they have worked with Brittany Ingle over the past year. The case will be sent to the judge on Wednesday and they hope to have a special prosecutor assigned sometime in the next week.

The probable cause documents also detail what happened following the sentencing of Alyssa Shepherd, the woman accused of striking and killing Ingle's three children at a bus stop in Rochester.

After Shepherd's sentencing, an officer was leading her out of the building when he claims Ingle rushed past him and attacked Shepherd. Shepherd was not handcuffed at the time of the alleged attack.

According to those documents, Ingle hit Shepherd in the head "with what appeared to be her hand/elbow," the force of which pushed Shepherd's head into the wall. Ingle had to be restrained by court security with the assistance of Indiana State Police.

After restraining Ingle, court documents say she was handcuffed and transported to the Fulton County Jail where she was booked on a preliminary charge of misdemeanor battery. She was later released on bond.

Court documents state Ingle told the arresting officer that she was upset over the verdict and her children's deaths saying "I f***ed up, didn't I?"

Shepherd was transported to Woodlawn Hospital where she received a CT scan and was checked for injuries. After her scan she was medically cleared with no injuries and booked into the Fulton County Jail.

Shepherd was sentenced to four years in prison, three years of home detention and three years of probation in the deaths of Alivia Stahl, 9, and her twin brothers, Mason and Xzavier Ingle, 6, after she disregarded a school bus stop arm and hit four children. 11-year-old Maverick Lowe was also seriously injured in the crash.

Jurors found Shepherd guilty on three counts of reckless homicide, passing a school bus causing injury, and criminal recklessness resulting in serious injury.
