INDIANAPOLIS — A Missouri judge ordered Anthony Dibiah, an Indianapolis man accused of killing his 10-year-old son, to be extradited to Indiana where he will face a murder charge.

Dibiah, 37, has been held at a jail in Macon, Missouri, since Missouri State Highway Patrol officers arrested him July 19 as he drove away from Indiana.

Indiana authorities have until 10 a.m. Aug. 3 take Dibiah into custody. On Friday, the judge ordered Dibiah to be released if he is not picked up by that time, according to online court records.

The Marion County Prosecutor's Office charged Dibiah on July 20 with murder in the death of his son, Nakota Kelly.

According to probable cause documents, Dibiah told someone over the phone that he suffocated his son with a bag until he stopped breathing. Dibiah said he took Nakota into the bathroom to "make sure he was dead" and then dumped his body, the documents said.

Indianapolis Metropolitan Police Department detectives are still searching for Nakota's remains.
