HANCOCK CO. — A Greenfield home improvement contractor is facing a lawsuit from the Indiana Attorney General’s office, which accuses the business of deceiving consumers.
The state filed a lawsuit last month against Strong Back Construction LLC and its operator, Robert Mills, alleging violations of the Indiana Deceptive Consumer Sales Act and Indiana Home Improvement Contracts Act.
At least eight consumers contracted with Strong Back Construction and paid down payments, but the company failed to perform the services, the lawsuit says.
Mills has also conducted business under the name Indiana Concrete, an unregistered company.
Since July 2016, Mills obtained down payments, typically 50 percent of the contract price, and represented they would complete the services by a specific or approximate date.
For example, a Greenwood family reached a contract with Mills in July 2018 to construct a barn for a total contract price of $95,000.
After paying Mills $30,000, Mills began excavation of the Greenwood site and partially completed building the concrete forms, but did not finish the job, according to the lawsuit.
The state is seeking restitution for consumers, as well as a permanent injunction that would prevent Mills from owning, operating, or managing any company involved in home improvement services.
Mills has not been criminally charged in Hancock County, but he does have a pending theft charge in Madison County, and his trial is scheduled for May 2020.
